Weapons Offenses

Defending Texans against Weapons Charges

Most people in the State of Texas do not know all of the distinctions between illegal and legal firearms. The difference is not always clear, but not knowing it can subject you to serious criminal charges. At the law firm of Capitaine, Shellist, Peebles & McAlister in Houston, Texas, the team of former Harris County prosecutors will work hard to defend you against weapons charges.

By using a legal team approach in every case that they handle, the attorneys utilize the skills and talents of not one, but three highly qualified criminal defense attorneys. Their use of this approach enables them to take advantage of all of their experiences when developing a powerful defense strategy against weapons charges such as:

  • Possession of an illegal firearm
  • Violations of conceal and carry law
  • Weapons trafficking
  • Felon in possession of a firearm
  • Brandishing or discharging a firearm
  • Unlawful carrying of a weapon

Don't make the mistake of providing the police with even more incriminating evidence. Before speaking to law enforcement, contact the firm for a free consultation.

The Travelers Defense in Weapons Cases

There have been several changes to the weapons laws in Texas since 2005. Here is a brief summary of the changes that you may need to be aware of:

  • Renewal time has been extended from 4 years to 5 years for licenses. The renewal fee for seniors (60 years or older) fee is reduced to $35.00. New licenses will be issued for 5 years.
  • Active duty military, or honorably discharged veterans, may obtain a license when they are 18 years of age. All fees to the state are cut in half for active duty military only and range qualification is optional if you qualified with a handgun (not a rifle) in the last five years. You will need to send DPS proof of this by certification or notation in your military records.
  • You may have heard about a new law allowing Texans to carry a handgun in their private vehicle without a license. This law, in effect, switches the burden of proof to the prosecutors to prove that you were not traveling.
